I think a furniture company is taking my husband to court?

My husband and I got a living room set thru a furniture company about 4 months ago. We paid 2 payments and my husband lost his job. We are now 2 payments behind and they are threatening to take us to court. They will not come and get the furniture they are wanting to take us to court. We can not afford the furniture and we are not sure what to do. If they take us to court what will happen?I think a furniture company is taking my husband to court?
They are probably trying to scare you but you never know. Usually they ask for payment or the furniture back. Since they do not want the furniture back, I would suggest a payment plan to get caught up but if that is not possible try selling it. Then you can pay what you make and if there is a balance most likely it will be a little easier to manage. Just a thought.I think a furniture company is taking my husband to court?
They will NOT sue with you being two months late. It will more than likely take them 4-7 months longer, but they more than likely will never sue. It doesn't even sound like you've been turned in to collections yet! Try to get caught up and keep paying them, but if you just can't, then don't. If you get 6-9 months behind, and they actually do sue (which I doubt) the papers you were served should have a lawyers name on the back. Call them. They'll be more likely to settle than the actual furniture company. If you continue to get behind and then your husband gets a new job, don't start paying them (depending on how far behind you are at the time) Just build up cash to you have money to settle. They'll usually take anywhere from 30 to 60 cents on the dollar.


Never give them access to your checking account. And ANY settlement they come up with, get it in writing before you send money.


And never ever listen to what they have to say. They say alot of things, like ';We're going to sue you'; but if their lips are moving, they're lying.
if you got the furniture 4 monthes ago and made two payments they won't come get the furniture. Just try to send them as much money as you can although your payments are set...they can not and will not refuse the money you send...they will keep hassling you for more money though so get used to it and get thick skin and smile while you are on the phone with them (wanting in the back of mind to tell them off and shoove it . you know you can't )


we are going through that too, we have one more payment to go. PATIENCE INDURANCE you' ll get through this.


if you don't want the furniture, sell it but you won't get the price you need to pay off whole amount of financing from company.
Tell the furniture company to provide with a copy of your original loan agreement - if you don't already have it. This document explains all of their rights and yours. If you or your husband never signed any such agreement, then the furniture company probably has no rights to any of your property. Also you should check the fair collections practices act because I'm not sure they are in compliance with it:

If none of this helps, you should speak to a lawyer.
A furniture company taking you to court?!!? Let them take you to court.. who's name was the furniture loan under, yours or your husbands..usually they send you to collections





i think they are trying to scare you..how much do you owe?





tell them that they are wasting their time, just come and take the furniture.because you have no money, they are not going to get a penny out of you..your husband lost his job, therefore he has no wages to be garnished....what were the loan terms
If they sue you and prevail, they can attach property or wages. Likely, they will do both.





Why not contact them and make arrangements?
