Can my husband allow his son's stepfather to adopt him without losing his rights?

My husband's ex-wife is now married to a man in the military. He is being deployed in a few months and she wants to know it my husband would be willing to sign over rights so their son would receive benefits if something happens to her husband. My question is can my husband allow the stepfather to adopt his son without losing legal visitation? I guess I am asking if he can he have 3 legal parents?Can my husband allow his son's stepfather to adopt him without losing his rights?
No. Your husband's child cannot have three legal parents and if your husband consents to this adoption (this includes permanently severing your husband's parental rights over his own child), that child will have a new father...his mother's husband...and it won't be his biological father any more.





Please don't let him do it as it is a trap. The second he signs that paper, he loses all rights to his child and he will never get them back because he willingly allows another man to adopt his child, especially for possible financial benefits. And if that child is adopted, your husband will no longer have the right to visit his own child as it won't be his child anymore: he will be the child of another man!

No. If your husband signs away his parental rights, then the step-dad could possibly adopt the son. Not legal to have 3 parents. But then your husband wouldn't be responsible for child support. Possibly the ex-wife would still, informally, allow visitation. But if the military found out, they would probably revoke any rights or benefits the son would have had.

Third parent adoption ';replaces'; the birth father with the new father. The birth father no longer has ANY rights or obligations with regard to the child.





Of course, that does not prevent the three adults involved coming to any private arrangement they want. If the birth father, birth mother, and step-father/adoptive father can all cooperate to co-parent the child that is the best of all possible results.

Once your husband signs away his rights and the child is adopted by his step father,your husband is no longer legally the child's father. He will have no rights whatsoever.
As soon as the stepfather adopt the boy, the natural father is losing all his write except visitation
